Please read these terms first before using ZENABM.COM. By using ZENABM.COM, you accept these terms ("Agreement"). These terms repeatedly include words as "we", "our", "you", "customer", "your", "terms", "services". In order not to get confused, take a look at this explanation of what we mean when we use these words:
– "we", "our" – ZenABM LTD, company number 13573194
– "you", "user", "your" – a person or a company registered at our website/app in order to use ZENABM.COM
– "Terms" – Terms of Services including Privacy and Data Privacy
– "Services" – our website, application programming interfaces, mobile applications, web-app, browser plugins and the content of ZENABM.COM.
ZenABM LTD is the owner of Services and ZENABM.COM.
The following Terms govern all use of the ZENABM.COM website ("the Website"), application programming interfaces, web-app, mobile applications and browser plugins.
General Provisions
By clicking "I accept," or by downloading, installing, or otherwise accessing or using the Services, you agree that you have read and understood, and, as a condition to your use of the Services, you agree to be bound by, the following terms and conditions, including ZENABM.COM privacy policy and any additional terms and policies ZENABM.COM may provide from time to time. If you are not eligible, or do not agree to the terms, then you do not have our permission to use the Services. Your use of the Services, and ZENABM.COM's provision of the Services to you, constitutes an Agreement by ZENABM.COM and by you to be bound by these Terms.
The Website and Services are available only to individuals who are at least 13 years old.
Services provided by ZENABM.COM
ZENABM.COM provides access to web application, will be available at https://app.zenabm.com.
Default account that you set up in ZENABM.COM will be free of charge (no subscriptions required) but will be limited to a trial period.
Different type of ZENABM.COM accounts have different features and limits.
How an Agreement between user and ZENABM.COM may be reached
You set up free account using email or Google authorization;
You can at any time upgrade account to paid plan (payments are recurrent, with monthly or annually subscriptions);
You will receive email notification after upgrade;
Security
You are solely responsible for maintaining the confidentiality of your account and password, and you accept responsibility for all activities that occur under your account. If you believe that your account is no longer secure, then you must immediately notify us at mj[at]zenabm[.]com
Available payment methods
Payments can be made using credit card via our payment provider Paddle.com.
ZENABM.COM does not store any sensitive data (like credit card numbers, or passwords to external services).
Paid subscriptions – period of validity
By upgrading account you agree to pay ZENABM.COM the monthly or annual subscription fees indicated for that service. Payments will be charged on the day you sign up for a premium service and will cover the use of that service for a monthly or annual period as indicated.
If you have an upgraded ZENABM.COM account (you are an Account Holder) you agree to receive invoices electronically. Invoices are displayed in the Application only after the user logged in.
Canceling paid subscriptions
If you subscribed to paid plan, you can cancel it at any given time without giving a reason.
Canceling of subscription can be done using Paddle client portal - following the link sent to you by Paddle.com during initial subscription and with each invoice.
Licenses
All content included on the Website, such as text, graphics, logos, button icons, images, data compilations, and software, is the property of ZenABM LTD or its content suppliers and protected by United Kingdom's and international copyright laws.
The compilation of all content on ZENABM.COM is the exclusive property of ZenABM LTD and protected by United Kingdom's and international copyright laws.
All software used on (or provided through) the Services is the property of ZenABM LTD or its software suppliers and protected by United Kingdom's and international copyright laws.
Permission to Use
Subject to your complete and ongoing compliance with these Terms, ZenABM LTD grants you limited, non-transferable, non-sublicensable, revocable permission to access and use the Service for your personal, internal use during the term of Agreement.
Restrictions
User shall not, nor permit anyone else to, directly or indirectly:
- reverse engineer, disassemble, decompile or otherwise attempt to discover the source code or underlying algorithms of all or any part of the Services (except that this restriction shall not apply to the limited extent restrictions on reverse engineering are prohibited by applicable law);
- modify or create derivatives of any part of the Services;
- rent, lease, or use the Service for timesharing or service bureau purposes; or
- remove or obscure any proprietary notices on the Services. As between the parties, ZenABM LTD shall own all title, ownership rights, and intellectual property rights in and to the Service, and any copies or portions thereof.
User shall not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Services or in any way reproduce or circumvent the navigational structure or presentation of the Services to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Services. ZenABM LTD reserves the right to bar any such activity.
User shall not attempt to gain unauthorized access to any portion or feature of the Services, or any other systems or networks connected to the Services or to any ZenABM LTD server, or to any of the services offered on or through the Services, by hacking, password "mining", or any other illegitimate means.
User shall not probe, scan or test the vulnerability of the Services or any network connected to the Service, nor breach the security or authentication measures on the Services or any network connected to the Services.
User shall not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Services or ZenABM LTD's systems or networks, or any systems or networks connected to the Services or to ZenABM LTD.
User shall not use any device, software or routine to interfere or attempt to interfere with the proper working of the Services or any transaction being conducted on the Services, or with any other person's use of the Services.
User shall not use the Services or ZENABM.COM for any purpose that is unlawful or prohibited by this Agreement.
Any violation to the restrictions results in immediate suspension of the service without any claims to accessing the content stored within Services or refunds.
Intellectual Property in Customer Data
As between you and ZenABM LTD, you retain all right, title and interest in and to the data, records and materials you transmit to or make available to the Services, including data synchronised from any customer relationship management system you connect ("Customer Data"). Nothing in these Terms transfers ownership of your intellectual property to ZenABM LTD.
You grant ZenABM LTD a non-exclusive, worldwide, royalty-free licence to host, copy, process and display Customer Data solely to the extent necessary to provide, maintain and support the Services for you, and otherwise in accordance with our Data Processing Agreement where one is in place.
ZenABM LTD may compile and use aggregated and irreversibly anonymised data derived from use of the Services for the purposes of operating, improving and benchmarking the Services, provided that such data is aggregated across a sufficient number of customers that neither you nor any individual nor any account of yours is identifiable, and is not disclosed in a form that identifies you. Such aggregated and irreversibly anonymised data does not constitute Customer Data.
Confidentiality
Each party may receive information from the other that is designated as confidential or that ought reasonably to be considered confidential given its nature or the circumstances of disclosure ("Confidential Information"). Customer Data is your Confidential Information. Our security documentation, technical and organisational measures documentation, non-public pricing and product roadmap are our Confidential Information.
Each party shall keep the other's Confidential Information confidential, use it solely for the purpose of performing its obligations or exercising its rights under these Terms, and disclose it only to those of its personnel and professional advisers who need to know it for that purpose and who are bound by obligations of confidentiality no less protective than those set out here.
Confidential Information does not include information that is or becomes publicly available other than through breach of this section, was lawfully known without restriction before disclosure, is lawfully received from a third party without restriction, or is independently developed without use of or reference to the other party's Confidential Information. Either party may disclose Confidential Information to the extent required by law, by a court of competent jurisdiction, or by a regulatory or supervisory authority.
These obligations continue for three (3) years following termination of your use of the Services, save that obligations in respect of personal data continue for so long as that personal data is held.
Acceptable Use
By using the Services you agree not to:
- use the Services for any illegal purpose or in violation of any law;
- violate, or encourage others to violate, any right of a third party, including by infringing or misappropriating any third party intellectual property right.
Indemnification
You agree to indemnify and hold harmless ZenABM LTD, its contractors, its licensors, and their respective directors, officers, employees and agents from and against any third-party claims, damages, and reasonable expenses (including reasonable attorneys' fees) to the extent arising out of: (a) your breach of this Agreement; (b) your violation of any applicable law or regulation; or (c) your infringement or misappropriation of any third-party right. This obligation does not apply to the extent a claim arises from ZenABM LTD's own breach, negligence, or wilful misconduct.
Withdrawing from ZENABM.COM
You can delete your ZENABM.COM account completely by contacting us at mj[at]zenabm[.]com
Complaint Policy
You can file complaint by sending email to mj[at]zenabm[.]com. Reply will be sent to you within up to 14 work days since complaint delivery.
Warranties
The Website is provided "as is". ZENABM.COM and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither ZENABM.COM nor its suppliers and licensors, makes any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Website at your own discretion and risk.
Limitation of Liability
Nothing in these Terms excludes or limits either party's liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
Subject to the paragraph above, neither party shall be liable to the other for any loss of profit, loss of revenue, loss of anticipated savings, loss of goodwill, loss of business or business interruption, or for any indirect or consequential loss, in each case whether arising in contract, tort (including negligence) or otherwise.
Subject to the paragraphs above, each party's total aggregate liability arising out of or in connection with these Terms and your use of the Services, whether in contract, tort (including negligence), indemnity or otherwise, shall not exceed the greater of (a) the total fees paid or payable by you in the twelve (12) months preceding the event giving rise to the liability, or (b) GBP 100.
These limitations shall not apply to liability arising from fraud, fraudulent misrepresentation, wilful misconduct or gross negligence.
Where you and ZenABM LTD have entered into a separate written agreement containing limitation of liability provisions, those provisions prevail over this section to the extent of any inconsistency.
GDPR Compliance
ZenABM LTD (operating as ZENABM.COM) is fully compliant with the General Data Protection Regulation (GDPR). Our compliance is based on the following principles:
Data Collection and Processing
- We collect and store only minimal user personal data required for account operations: email address and name provided during signup, and password (stored in encrypted form)
- When you connect your LinkedIn account, we access only company data from your LinkedIn Ad accounts - we do not collect, store, or process any personal data from LinkedIn
- If you choose to connect a customer relationship management system such as HubSpot or Salesforce, we process the records you make available through that connection, which may include business contact details such as name, business email address, job title and company affiliation. This integration is optional and is controlled entirely by you. Our processing of that data is governed by our Data Processing Agreement.
- We do not sell your personal data, and we do not share it with third parties for their own purposes. We use a limited number of vetted sub-processors (for example, hosting and infrastructure providers and our AI provider) who process data solely on our behalf, under written agreements and appropriate safeguards. Your Rights Under GDPR
As a user, you have the right to:

- Request restriction of processing

Data Protection Measures
- All personal data is securely stored with appropriate technical measures
- We retain your data only for as long as necessary to provide our services
- We implement appropriate security measures to protect your personal data
We may use your anonymized data for reporting and benchmarking purposes. This includes aggregated and anonymized usage statistics, performance metrics, and other non-personally identifiable information that helps us improve our services and provide industry insights.

Governing Law and Jurisdiction
These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, their subject matter or formation, are governed by and construed in accordance with the law of England and Wales. Each party irrevocably agrees that the courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim.
Where a separate written agreement between you and ZenABM LTD states a different governing law or jurisdiction, that agreement prevails to the extent of any inconsistency.
